Es gibt natürlich immer “geheime” formulierungen du gut klingen aber negativ sind. Diese kann man aber mittlerweile auch ahnden. Wenn die berufliche beurteilung gut ist und das Arbeitszeugnis schlecht ausgestellt wird ist das quasi ein slamdunk vor gericht festzustellen, dass das arbeitszeugnis als vergeltung schlecht ausgestellt wurde. Das wichtige ist Dokumentieren zu können (emails, berufliche beurteilung), dass man gut gearbeitet hat und daher das Arbeitszeugnis Falsch ausgestellt wurde. Man kann den ehem. Arbeitgeber dann auch zwingen ein korrektes Zeugnis aus zu stellen. Ggf reicht da auch ein einfacher brief vom anwallt der denen die sachlage erklärt.
